L1What happened
The Sala Penal Transitoria ruled in Recurso de Nulidad 1243-2024, reviewing a June 19, 2024 sentence (Investiga; LP Derecho). Sabino Rodrigo Valentín Rutti, a non-commissioned officer at the Manta base according to the victims, got 12 years for raping two women; Rufino Donato Rivera Quispe, Vicente Yance Collahuacho, Amador Gutiérrez Lisarbe (LP Derecho spells it Lizarbe), Arturo Hernán Simarra García and Lorenzo Inga Romero got 10 years each; Pedro Chanel Pérez López got six. The court kept the sentences although the supreme prosecutor had asked to raise them to 18 and 20 years (La República). LP Derecho says Simarra García was head of the Manta base when the assaults took place.
L2Who’s affected
The victims were teenage and adult campesina, Quechua-speaking women from Manta and Vilca (La República). The court ordered the Ministry of Women, through its Women's Emergency Centres, to give the victims comprehensive care (La República; LP Derecho). It held that a victim's testimony can support a sexual-violence conviction even with no eyewitnesses to assaults inside the base's rooms (Investiga).
L3Why it’s quiet
Analysis · OVERLOOKED The coverage we found is Peruvian: La República, Investiga and LP Derecho. We did not find it in the 13 major U.S. outlets.
L4Deeper impact
Sentences start only once the men are caught. "Hasta la fecha solo dos de los condenados han sido detenidos" ("So far only two of the convicted have been detained"), said Carlos Rivera of the Instituto de Defensa Legal, adding that those arrests came weeks after the first-instance ruling. Justice Juan Carlos Checkley Soria dissented, arguing that under Law 32107 and Constitutional Court ruling 190/2025 the acts cannot be prosecuted as crimes against humanity, and proposed annulling the convictions. Rivera said the men could still seek the amnesty law, and the Constitutional Court has announced a ruling soon (La República). The court annulled Epifanio Delfín Quiñones Loyola's conviction and ordered a retrial, and ended the case against Raúl Ángel Pinto Ramos, who has died (La República; LP Derecho).
L5Full context
The abuses took place around counterinsurgency bases set up in the area from the 1980s against Shining Path attacks; it was one of 47 emblematic cases the Truth and Reconciliation Commission sent to prosecutors. The first trial opened in 2016 against 14 soldiers, and in June 2024 a lower court convicted 10 (La República). DEMUS called the ruling a historic achievement for survivors who waited more than 40 years (La República), and its director, Rocío Silva Santisteban, compared it to Guatemala's Sepur Zarco case (Investiga).
